The Bookmode API (the “API”) is an application programming interface service provided by Meteoric, LLC that programmatically returns data about books, editions, and authors. These API Terms and Conditions (the “Terms”) are inclusive of the Bookmode Privacy Policy (the “Privacy Policy”) and any other applicable Bookmode operating rules, policies, price schedules, and supplemental terms that may be published from time to time, which are expressly incorporated herein by reference and referred to, collectively, as the “Agreement.”

NOTICE: THE AGREEMENT CONTAINS DISCLAIMERS OF WARRANTIES, LIMITATIONS OF LIABILITY, RELEASES, INDEMNIFICATION PROVISIONS, A BINDING ARBITRATION AGREEMENT, AND WAIVERS OF CLASS ACTION AND TRIAL BY JURY. THESE PROVISIONS ARE AN ESSENTIAL BASIS OF THE AGREEMENT.

1. Your Consent to the Agreement; Modification

The Bookmode API is owned and operated by Meteoric, LLC (“Bookmode,” “we,” “our,” or “us”). You agree to the Agreement in its entirety when you: (a) access or use the Bookmode website (bookmode.io, the “Site”); (b) sign up for the Bookmode API; (c) access the Bookmode API; or (d) otherwise affirmatively consent to these Terms.

We may amend the Agreement from time to time in our sole discretion; provided that any amendment to the arbitration, class-action, or other dispute-resolution provisions will not apply to disputes arising before the amendment. The latest Agreement is posted on the Site, and your continued use of the API constitutes acceptance of the then-current Agreement.

Disclaimer. The Bookmode API aggregates data from many third-party sources — including publisher feeds, library and bibliographic databases, and licensed data providers — to produce a consolidated catalog of books, editions, and authors. We make a good-faith effort to keep this information accurate, but some inaccuracies are unavoidable and the API may return incomplete or inaccurate data at times. Please report inaccuracies to support@bookmode.io so we can correct them.

2. Requirements; Age

The Bookmode API is not available to anyone under the age of thirteen (13).

The Bookmode API is not available to anyone under the age of eighteen (18) (or the applicable age of majority in their jurisdiction) whose registration has not been approved by a parent or legal guardian. If you are a parent or guardian who consents to a minor's use of the API, you agree to be bound by the Agreement in connection with that minor's use.

3. Approved Uses of API Data

You may use the non-image data returned by the API within a website or software application that you own and operate, including for commercial purposes. You may not resell, redistribute, sublicense, or otherwise make the data available to third parties as a standalone dataset, data feed, or competing data product or API.

  • Caching. You may cache non-image data returned by the API for up to ninety (90) days, after which it must be deleted or re-queried. You must delete all cached Bookmode data when your account is cancelled or terminated.
  • Attribution. If you access the API under a free plan, you must identify Bookmode as the data source and include a link to bookmode.io on each page or application screen where the data is displayed. Paid plans are not required to display attribution.
  • Book cover images and author photographs (“Third-Party Images”). Certain fields returned by the API (for example, cover-image URLs and author-photo URLs) may reference images hosted by third parties or obtained from publicly accessible sources. Third-Party Images are provided, if at all, solely as a convenience and reference. They are not part of any license grant from Bookmode, and Bookmode grants you no ownership interest or intellectual-property license in any Third-Party Image.
    • No rights clearance; publicly accessible does not mean public domain. The fact that an image is publicly accessible, indexed, or returned by the API does not mean it is in the public domain, royalty-free, cleared for commercial use, or non-infringing. You are solely responsible for determining whether you have all rights, consents, and licenses necessary to use any Third-Party Image.
    • Hosting; no hotlinking. If you determine you have the right to use an image asset, you are solely responsible for hosting and serving it from your own infrastructure. Hotlinking to images hosted on Bookmode's CDN or servers is prohibited.
    • Removal on notice. Bookmode may modify, disable, or cease returning any image URL at any time. Upon notice from Bookmode, you must promptly cease use of and delete any affected Third-Party Image from your systems.
  • Ratings data. Aggregate ratings returned by the API are attributed aggregate numbers provided as factual data points. They are subject to the same no-resale restriction above and may be sourced through licensed channels subject to additional provider requirements we may communicate.

4. Quotas / Rate Limiting

Your Bookmode API account has both a monthly quota and a per-minute rate limit. We will restrict your access if either is exceeded. Each API call costs one (1) credit toward your monthly quota; certain “appended” or sub-resource calls may cost more than one credit. We may change the way credits are counted or change pricing plans and included credit amounts, but existing customers will receive at least thirty (30) days' notice before any such change takes effect.

5. Ownership

The Bookmode API — including its organization, design, compilation, software, and services, and all Bookmode logos, trade dress, and “look and feel,” together with all related intellectual property — is the sole and exclusive property of Meteoric, LLC. The “Bookmode” name and logo are trademarks of Meteoric, LLC. We reserve all rights not expressly granted.

Third-party source, publisher, and platform names and trademarks (including Open Library, Goodreads, Amazon, ISBNdb, and Google Books) are the property of their respective owners and are used only nominatively to identify data sources and comparable services. All copyrights and other rights in Third-Party Images remain with their respective owners; inclusion of a URL or reference in the API is not authorization or a representation that you may lawfully use that image.

6. License

Each user is granted a non-exclusive, non-transferable, revocable, and limited license to access and use the Bookmode API solely as permitted in Section 3. Bookmode may terminate this license at any time. No user may: use any automated means or scraping to collect data other than through the API as permitted; copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, or reverse engineer the API; create derivative works from the API; or exploit the API in any manner not expressly permitted. Bookmode reserves any rights not explicitly granted.

7. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE BOOKMODE API AND ALL DATA AND SERVICES PROVIDED THROUGH IT ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE API WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY DATA OBTAINED THROUGH IT WILL BE ACCURATE OR RELIABLE. WITH RESPECT TO ANY THIRD-PARTY IMAGE, WE MAKE NO REPRESENTATION OR WARRANTY THAT WE OWN OR HAVE LICENSED IT, THAT YOU HAVE ANY RIGHT TO USE IT, OR THAT IT IS NON-INFRINGING. ANY USE OF THIRD-PARTY IMAGES IS ENTIRELY AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THE DISCLAIMER OF IMPLIED WARRANTIES, SO THE FOREGOING MAY NOT APPLY TO YOU IN ITS ENTIRETY.

8. Limitations of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NEITHER WE NOR OUR SUPPLIERS OR LICENSORS WILL BE LIABLE FOR ANY INDIRECT, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR INCIDENTAL DAMAGES (INCLUDING LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL) ARISING OUT OF OR RELATING TO THE AGREEMENT OR THE BOOKMODE API, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR MAXIMUM AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE AGREEMENT OR THE BOOKMODE API WILL NOT EXCEED THE GREATER OF FIVE HUNDRED DOLLARS ($500) OR THE TOTAL FEES YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE LIABILITY. CERTAIN JURISDICTIONS DO NOT ALLOW THESE LIMITATIONS, SO THEY MAY NOT APPLY TO YOU.

9. Miscellaneous

  • (a) Technical Difficulties. We are not responsible for delays, disruptions, or technical interruptions affecting the API, including problems with computer systems, carriers, or internet service providers.
  • (b) Linked Sites. The Site and API responses may reference third-party websites, services, or image hosts. We are not responsible for third-party sites or content, and your dealings with them are subject to their own terms and privacy policies.
  • (c) Privacy Policy. The Bookmode Privacy Policy, located at bookmode.io/privacy, is incorporated into these Terms by reference.
  • (d) Representations and Warranties. Each user represents that the Agreement is its valid and binding obligation, that it has independently evaluated the API, and that its use of the API will not violate applicable law or infringe the rights of any third party.
  • (e) Our Rights and Remedies; No Waiver. No Bookmode right or remedy is exclusive of any other, and our failure to enforce any provision is not a waiver of it.
  • (f) Assignment. We may assign the Agreement at any time. You may not assign the Agreement or transfer any right to use the API.
  • (g) Severability. If any provision is held invalid or unenforceable, the remaining provisions continue in effect.
  • (h) No Third-Party Beneficiaries. The Agreement is solely for your and our benefit.
  • (i) Indemnification. You agree to indemnify and hold Meteoric, LLC and its members, directors, officers, employees, and agents harmless from any claims, losses, and costs (including reasonable attorneys' fees) arising out of or relating to: your breach of the Agreement; your use of the API; your violation of applicable law; and your access to, caching, hosting, display, distribution, or other use of any Third-Party Image or other third-party content returned or referenced by the API, including any failure to obtain the rights or comply with the source terms for such content.
  • (j) California Users. Under Cal. Civ. Code § 1789.3, California residents may file complaints with the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by phone at (800) 952-5210.
  • (k) U.S. Government Users. The API and any software are “commercial items” as defined in 48 C.F.R. 2.101, and U.S. Government users acquire only the rights set forth herein.
  • (l) Conflicting Terms. To the extent anything associated with the API conflicts with the Agreement, the Agreement takes precedence. Headings are for reference only.

10. Copyright Policy / DMCA Compliance

Bookmode reserves the right to terminate the account of any user who infringes third-party copyrights. If you believe a copyrighted work has been copied or made available through the API in a way that constitutes infringement, please provide our Copyright Agent with the information required by 17 U.S.C. § 512(c)(3): a signature of the person authorized to act for the owner; identification of the copyrighted work and the allegedly infringing material and its location; your contact information; a statement of good-faith belief that the use is not authorized; and a statement, under penalty of perjury, that the information is accurate and that you are authorized to act.

11. Dispute Resolution, Class Action Waiver, and Arbitration

The Agreement is governed by the laws of the State of Texas (without regard to conflict-of-law principles). The parties agree to arbitrate all claims arising under the Agreement before the American Arbitration Association (AAA) in Austin, Texas, under its then-current Commercial Arbitration Rules. Before filing, you agree to first attempt to resolve the dispute by sending a written description of it to support@bookmode.io; we may provide a final written settlement offer. For claims of $10,000 or less, you may choose whether the arbitration proceeds in person, by phone, or on submissions only. Any award is final and may be entered in any court of competent jurisdiction.

To the extent permitted by law, you agree not to bring, join, or participate in any class action against Bookmode. This class-action waiver is an independent agreement. You may opt out of these dispute-resolution provisions by sending written notice within thirty (30) days of first accessing the Site or API.
